How to Open a Business in the City of Hialeah Gardens

To establish a business within the City of Hialeah Gardens, first check with the Planning and Zoning Department to make certain that the business/occupation applying for licensure is permitted at the intended address.

  • Complete a Local Business Tax Receipt application.

  • Complete a Certificate of Use application.

  • All businesses must comply with the South Florida Building Code and City of Hialeah Gardens Ordinance 2001-09 (Chapter 46 of the Code of Ordinances).

  • Except as otherwise provided, local business tax receipts shall expire on the 30th day of September of every year. Those receipts not renewed by October 1st, shall be considered delinquent and subject to a delinquency penalty of 10% for the month of October plus an additional 5% for each month of delinquency thereafter until paid; provided that the total delinquency fee shall not exceed 25% of the yearly local business tax receipt fee for the delinquent establishment.

  • Every local business tax receipt shall be posted in a conspicuous location in the place of business for which it was issued. Failure to comply with posting of the receipt shall be punishable with a fine of $50.00.

  • When activities are carried out at the same location that are of a different classification not necessary to the operation of the business for which a local business tax receipt was issued, a separate receipt is required for each business even if conducted under a single ownership.

  • Exit sign(s) shall be illuminated and placed directly above all doors, directly leading to the outside of the building. (Except on overhead doors, there shall be adjacent to the door a readily visible, durable sign that reads “THIS DOOR TO REMAIN OPEN WHEN THE BUILDING IS OCCUPIED” in letters no less than one inch high on a contrasting background (NFPA 101 5.0, 5- 2.1).
  • One 5 lb. “ABC” type fire extinguisher per 3,000 square feet, with current certified tag, hung no higher than 5 feet from the top of the fire extinguisher as determined necessary in order to ensure public safety (2A: 10BC) (NFPA 10).

  • Panel boxes must be completely sealed, no open slots will be allowed (NFPA 96).

  • An operable exhaust fan must be installed in all bathrooms on the premises. (HRS TITLE 14).

  • All businesses are responsible for obtaining all county and/or state licenses and any other requirements.
